Injuries to drivers can range from severe head injuries to minor whiplash. We are equipped to deal with all types of claims; no matter how small or how large.
In some cases, the accident will clearly be someone else's fault; for example in "a rear end shunt". In these cases, the question of liability (who is to blame) is easily resolved.
However, many accidents are more complicated than this and it may be harder to establish whose fault the accident was. For example, you could have been travelling over the speed limit or not wearing a seatbelt. Although these are relevant factors, they do not automatically prevent you from bringing a claim and you need specialist advice on these points.
When the person bringing the claim is partially responsible for the accident, the legal term used is contributory negligence. If you contribute to the accident, it simply means that the amount of your compensation is reduced by the same percentage for which you were to blame. Therefore, if you are found to be 20% to blame; your compensation would be reduced by 20%.
